Firearm definition to include
muzzle-loading and black powder weapons.
ENTITLED, An Act to revise the definition of firearm to include certain antique, muzzle-loading,
and black powder weapons in certain circumstances.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That chapter 22-14 be amended by adding thereto a NEW SECTION to read as
follows:
For purposes of §§ 22-14-15 and 22-14-15.1, the term, firearm, includes any antique firearm
as defined in subdivision 22-1-2(4) and any muzzle loading rifle, muzzle loading shotgun, or
muzzle loading pistol, including muzzle loading weapons that are designed to use black powder
or a black powder substitute and cannot use fixed ammunition.
