The effective date of the legislation of the Special Session of the 80th Legislative Assembly is
October 17, 2005.

Appropriation for costs related to laboratory project at the former Homestake Mine in Lead, South Dakota.
Section
1.
There is hereby appropriated from the state general fund the sum of nineteen million
eight hundred eighty-seven thousand six hundred thirty dollars ($19,887,630) to the Science and
Technology Authority for the purpose of a project, as defined in subdivision 1-16H-3(3), at the
former Homestake Mine in Lead, South Dakota.
Section
2.
The moneys appropriated in section 1 of this Act shall be expended for the project
in accordance with chapter 1-16H.
Section
3.
The provisions of
§
4-8-21 do not apply to the moneys appropriated by this Act. If
the former Homestake Mine is transferred back to its previous owner, any unspent moneys from
this appropriation shall revert to the state general fund.
Section
4.
If, by June 30, 2012, the moneys appropriated by this Act which are not spent are
not contractually obligated by a written agreement, or if, by June 30, 2012, the moneys are
contractually obligated but the written agreement is thereafter terminated, the unspent moneys shall
revert to the state general fund.
Section
5.
The Legislature finds that the appropriation provided for by this Act is for a public
use or benefit.
Section
6.
Whereas, this Act is necessary for the support of the state government and its
existing public institutions, an emergency is hereby declared to exist, and this Act shall be in full
force and effect from and after its passage and approval.
