         FOR AN ACT ENTITLED, An Act to  regulate an insurer's use of global positioning systems in motor vehicles.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
     Section  1.  No insurer of motor vehicles may:
             (1)    Require the use of a global positioning system in an insured motor vehicle;
             (2)    Increase the premium of the insured based on any information collected from a global positioning system;
             (3)    Cancel coverage based on information collected from a global positioning system; or
             (4)    Share information collected from a global positioning system with any other person unless subpoenaed by a court.
