A JOINT RESOLUTION,
To revise and establish certain constitutional provisions regarding
the lieutenant governor and the presiding officers of the Senate and House of
Representatives.
BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE STATE OF SOUTH
DAKOTA, THE SENATE CONCURRING THEREIN:
Section
1.
That at the next general election held in the state, the following amendments to
Article III and Article IV of the Constitution of the State of South Dakota as set forth in section
2 and 3 of this Joint Resolution, which is hereby agreed to, shall be submitted to the electors of
the state for approval.
Section
2.
That Article III be amended by adding thereto a NEW SECTION to read as
follows:
§
33. The members of the senate shall elect one member to preside as president of the
senate.
The members of the house of representatives shall elect one member to preside as speaker
of the house of representatives.
Section
3.
That Article IV, section 5 of the Constitution of the State of South Dakota, be
amended to read as follows:
§ 5.
The lieutenant governor shall be president of the senate but shall have no vote unless
the senators be equally divided.
The lieutenant governor shall perform the duties and exercise
the powers that may be delegated to him by the Governor.
Section
4.
The provisions of sections 2 and 3 of this Joint Resolution are effective January 1,
2011.
