FOR AN ACT ENTITLED, An Act to redact certain information from public records that may
endanger a person's life or safety.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. Any judge, prosecutor, law enforcement officer, probation officer, parole officer,
or correctional officer who claims information disclosed in a public record may endanger the
person's life or safety pursuant to subdivision 1-27-1.5(23) may request in writing to the state
or any of its political subdivisions to have his or her address or other identifying information
removed from a public record.
The person shall complete an affidavit stating that he or she
meets the criteria of this section and § 1-27-1.5. and shall sign the affidavit under penalty of
perjury. The state or the political subdivision shall remove such information from its website
and deny access to such information, except by court order.
