HCR 1005 Introduced by: Representatives Jensen, Hubbel, Magstadt, Olson (Betty), Steele, and Venner and Senator Schlekeway

A CONCURRENT RESOLUTION, Urging Congress to clearly delegate responsibility for the regulation of hydraulic fracturing to the states.

WHEREAS, hydraulic fracturing, a mechanical method of increasing the permeability of rock, thus increasing the amount of oil or gas produced from the rock, has greatly enhanced oil and gas production in North Dakota; and

WHEREAS, oil and gas production increases have led to growth in employment and economic development as well as promotion of energy independence for the United States; and

WHEREAS, the State of South Dakota, through the Department of Environment and Natural Resources, has proven more than capable of regulating oil and gas recovery processes and ensuring the safety of workers while protecting the environment; and

WHEREAS, the state is best situated to closely monitor oil and gas drilling and fracturing operations to ensure they are conducted in an environmentally sound manner:

NOW, THEREFORE, BE IT RESOLVED, by the House of Representatives of the Eighty-seventh Legislature of the State of South Dakota, the Senate concurring therein, that the South Dakota Legislature urges the Congress of the United States to clearly delegate responsibility for the regulation of hydraulic fracturing to the states.

" Section 5. That § 10-23-2.1 be amended to read as follows:

10-23-2.1. In addition to the notice required by § 10-23-2, the county treasurer shall send the notice containing the information set forth in §§ 10-23-2.5 and 10-23-3 by first class mail or by electronic means to:

(1) Any owner of the real property at the owner's last known address;

(2) Any person holding a special assessment certificate which is a lien upon the real estate;

(3) If bonds have been issued in lieu of assessments certificates, to the holder of the bond last maturing; and

(4) If the property is located in a municipality, to the auditor, clerk, or finance officer of the municipality.

The county treasurer shall mail or transmit electronically the notice at least fourteen days before the day of sale. The county treasurer shall certify, on the tax certificate record book for that tax year, that notice was given in the manner prescribed by this section. ".

A LEGISLATIVE COMMEMORATION, Commending and honoring the Parker State Class B Boys' Cross Country Champions.

WHEREAS, the Parker team consisting of cross country runners seniors Matt Mielke, Seth Olson, and Trevor Miller; junior Duane Jongeling; and sophomores Michael Olson and Ryan Olson; and

WHEREAS, Duane Jongeling placed first in the State Class B Cross Country Meet held at Yankton Trail Park in Sioux Falls on October 22, 2011; and

WHEREAS, Coach Phil Bjorneberg was named South Dakota Boys' Cross Country Coach of the Year by the South Dakota High School Coaches Association (SDHSCA):

NOW, THEREFORE, BE IT COMMEMORATED, by the Eighty-seventh Legislature of the State of South Dakota, that congratulations be given to the Parker State Class B Boys' Cross Country Champions and coach Phil Bjorneberg on a great season.
