        FOR AN ACT ENTITLED, An Act to allow certain students to participate in the opportunity scholarship program under certain circumstances.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
    Section 1. That § 13-55-31.2 be amended to read as follows:
    13-55-31.2. Any student who does not meet the high school course requirements as provided in subdivision 13-55-31(3) is eligible for the opportunity scholarship program if:
            (1)    The student takes the test administered by the American College Testing Program ACT, Incorporated and earns a composite score of twenty-eight twenty-four or higher and achieves ACT college readiness benchmark scores equaling or exceeding eighteen for English, twenty-one for reading, twenty-two for math, and twenty-four for science; or
            (2)    The student takes the Scholastic Assessment Test and earns a verbal-mathematics score of twelve hundred fifty critical reading-mathematics score of one thousand ninety or higher, while also attaining sufficiently high markers in reading, writing, mathematics, and science as not to require remediation in any of those areas a college

readiness benchmark score of five hundred or higher each on the critical reading, mathematics, and writing sections of the test.

    This section is effective on July 1, 2013. Any student who completes a program of secondary education on or after May 1, 2012, may establish eligibility for the opportunity scholarship under the provisions of this section.
    Section 2. That § 13-55-31 be amended by adding thereto a NEW SUBDIVISION to read as follows:
    Any student who receives a program of secondary education pursuant to § 13-27-3 satisfies the eligibility requirements of subdivision 13-55-31(1).
