Benefits not paid employees of educational institutions for services between
successive academic years--Grounds for retroactive payments.
With respect to services performed
in any other capacity for an educational institution, no benefits may be paid to an individual on the
basis of the individual's services for any week that commences between two successive academic
years or terms if the individual performs the services in the first academic year or term and there is
a reasonable assurance that the individual will perform the services in the second one. If an
individual was denied compensation for any week, in accordance with this section, and is not offered
an opportunity to perform services for the educational institution in the second academic year or
term, that individual is entitled to a retroactive compensation payment for each week that the
individual filed a timely claim and was denied compensation solely by reason of this section.
